The City of Rochester would like to remind residents that posting signs on the public right-of-way, including the grassy area commonly known as the “boulevard,” is a violation of state law (Minn.Stat.160.2715). This includes stick signs, sandwich boards and banners that promote businesses, garage sales or signs for political candidates. The right-of-way includes public streets, bridges, medians, bike lanes, sidewalks, boulevards, trails and pedestrian bridges over roadways. In most cases where sidewalks are present, the right-of-way extends to at least the edge of the sidewalk closest to private property – this includes the area between the sidewalk and the street.
Public Works crews will remove illegally placed signs on the city’s right-of-way and hold them at the Public Works Transit and Operations Center (PWTOC), located at 4300 East River Road NE. Pick-up of collected signs can be coordinated by calling 507-328-2450.
Violation of Minn.Stat.160.2715 is a misdemeanor. Civic penalties may also apply if the placement of signs contributes to a motor vehicle crash and injures a person or damages a motor vehicle that runs off the road. All state, county, city and township roads and highways fall under the same state law.
The Minnesota Outdoor Advertising Control Act (Minn.Stat.173.15) also prohibits placing advertising materials on public utility poles, trees and shrubs, and painting or drawing on rocks or natural features.
